Any advice appreciated for what to do to take precaution from failing when someone wishes to fail you in a subjective clinical setting. What can I do to ensure fairness as this is my second time around with the same faculty that proven to be bias. Dean approved the retake based on obvious personality conflict involved. Do you think they will do it again.

You can not ensure fairness in any nursing program. The dip shit of the class in the nursing school I attended who continually failed tests, didn't show up for major testing until the next day and was completely inept in clinical graduated while two of us who got above average grades, had great attendance and were confident in our clinicals were ousted.
If I were you, I would try a different school or request another instructor who will hopefully not be biased towards you. Whatever you do...do not criticise your instructor. Even if it's sincere criticism. Don't ask questions. Don't offer information. Just keep your head down and do the work.
The dip shit I mentioned reminded the instructor of her son. He even told me that he made numerous clinical mistakes, but that he was "safe" because of this. This nursing school also informed us that they had to graduate as many "men" as possible, so that the women would be entitled to better pay! They never threw a male student out, even if he continually fell asleep in class or had too many absences. Nursing school is a gamble. I think this is why there is such a bad nursing shortage. It's due to the poor treatment of students and the bad reputation of nursing schools.
I also tried to get a different instructor due to bias, but they refused me. I hope you have better luck!
Even though the law is supposed to protect you against "discrimination", don't think it can't happen and they can't get away with it. It happened to me and another classmate. They got away with it this time. Now, they have the law watching them closely. If you have a legitimate complaint, find the right resources and act on it.
Keep in mind that the instructors cover for eachother. They will lie and change records to protect themselves. It's nearly impossible to fight them. Again, good luck.
